This Privacy Policy (“Privacy Policy”) describes how a4 Media, LLC and its wholly owned subsidiaries such as Juice Media, Inc. (together, “we,” “us,” or “our”) collect, disclose, use, and protect your information (“Information”) in connection with your access or use of, interaction with, and/or subscription to, our products, services, subscription-based websites, and applications (together, the “Products”) and your information (“Visitor Information”) in connection with your access or use of our websites (e.g., a4media.com and JuiceMedia.io) (the “Sites”). 

By accessing, using, and/OR subscribing to the product OR THE SITE that links to this Privacy Policy, you accept all applicable PARTS of this Privacy Policy. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD DISCONTINUE ALL USE OF THE PRODUCT AND/OR THE SITE IMMEDIATELY.

a4 General Privacy Practices.

We are an advanced advertising, technology, and data analytics group of companies based in the United States. We offer the Products for access and use in the United States only and as such are governed by applicable privacy and data security laws in the United States. We do not knowingly collect data from consumers outside of the United States. 

The Products help our advertiser clients reach, grow, and/or understand desired audiences. Some of the Products incorporate data sets that are compiled from publicly available information, data we licensed or purchased from our affiliates or third-party providers, as well as data directly supplied by our clients and/or, in certain limited cases, by individuals. 

Other than Lead Gen Information (defined below), all Information we collect, including data we use to create audience segments and Survey Information, undergoes a rigorous process in our affiliate's clean room where consumer-specific Personally Identifiable Information is stripped away. In the case of targeted advertising, the de-identified information is further aggregated into sets of pseudonymized identifiers that is linked to specific audience segments. Cookie-based audience segments are created by interfacing with our cookie match partners to onboard and match our data sets with pseudonymized identifiers. Information that has been “pseudonymized” means that it has been processed in such a manner that the information can no longer be attributed to a specific consumer without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that Personally Identifiable Information is not attributed to an identified or identifiable consumer. 

For purposes of this Privacy Policy, “Personally Identifiable Information” is Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personally Identifiable Information does not include aggregated data, anonymized Information, or other Information that does not identify and cannot reasonably be linked to a particular consumer or household (collectively, “Non-PII Data”). Non-PII Data may include, among other things, browser identification, the Internet service provider, duration of visit, and domain type. Non-PII Data does not reveal any Personally Identifiable Information about any specific consumer. 

Our collection, use, and disclosure of Non-PII Data are not subject to any of the restrictions in this Privacy Policy.

We Do Not Collect Sensitive Personal Information

Our Products and Sites are not intended to collect, and you must not provide, any Sensitive Personal Information to us. “Sensitive Personal Information” is as defined under applicable data privacy laws and/or any sensitive data, which if lost, compromised, or disclosed without authorization could result in substantial harm or unfairness to an individual (such as sexual orientation, non-conforming gender identify (such as transgender status), religion, sensitive health information or conditions, or any data regarding a person under the age of eighteen (18)).

How We Collect Information

  • Information You Provide To Us: We collect Information, which may include Personally Identifiable Information about you, when you voluntarily provide it to us. Such Personally Identifiable Information may include, among other things, your first and last name, your mailing address, your email address, your telephone number, and your payment card information. You can navigate through the Sites without giving us Personally Identifiable Information. 

For any Information collected via a social media  (i.e. Facebook, LinkedIn, Google), contact form, or other third party website contact form for lead generation purposes (“Lead Gen Information”), will be used to contact you about our Products and Sites, and add you to our email newsletter and other marketing materials, which you can unsubscribe from at any time. We may use Lead Gen Information to generate lookalike audiences to market our Products. We will not disclose any Lead Gen Information to any third parties.

  • Information We Collect Automatically: When you visit our Sites, we automatically log your IP address, device, device MAC id, your Internet browser, your Internet service provider, the duration of your visit, and your domain type. We consider this information to be Non-PII Data when it cannot be reasonably be used to identify a particular consumer.

  • Information Collected via Cookies, Web Beacons and Similar Technologies: We may also collect Visitor information in the following ways:

  • Cookies. Similar to most website operators, we (and our service providers) use “cookies” to collect information about your visit to our Sites and to manage information concerning your preferences. A cookie is a small piece of text sent to your browser by a website you visit. It does not collect or provide your name or any other Personally Identifiable Information about you. It can, however, be used by our Sites to note information about your visit, such as your type of web browser, operating system and Internet Protocol (“IP”) address, to better tailor the Site for you. It can also be used to recognize you when you return as a repeat visitor to our Sites. Cookies do not allow the Site to access Personally Identifiable Information that you have not otherwise provided. You can control what cookies are accepted by your computer through the settings on your web browser or by deleting them from your computer. Doing so, however, may limit the personalization available to you.

  • Clear GIFs. Like many websites, we (and/or our service providers) may use clear GIFs (also known as ‘web beacons,’ ‘Internet tags,’ or ‘pixel tags’). Clear GIFs are lines of code that allow websites to summarize overall visitor usage patterns and to provide personalized services. We may use clear GIFs, for instance, to track visitor preferences or to gather aggregated information about visitor usage patterns. We do not use clear GIFs to collect any Personally Identifiable Information about visitors to our Sites.

  • Passive Automatic Electronic Collection. Like operators of most other websites, we (and/or our service providers) collect and log information automatically, either directly or through a third party service provider. For example, we collect your IP address, the name and location of your Internet service provider, the type and version of your browser, the length of time you visit the particular Site, your search queries on the Site, and the average number of pages you viewed. Logging your IP address does not by itself provide us with your name, e-mail address, or home or work address. We use this log information for systems administration purposes and for technical troubleshooting. We may also use it to gather general demographic information about you, such as your general location.

  • Information Received From Third Parties. We may receive Information from third party data providers. We contractually require all such data providers to represent and warrant that all information provided to us was collected in compliance with all applicable laws, any required privacy notices were provided, any required consents were obtained, and any opt-out requests were processed before the data was shared with us.

  • Information Gathered Via Surveys. From time to time, we may collect Information, including Personally Identifiable Information, when you interact with our surveys (“Survey information”).  These surveys are completely voluntary and may be conducted in person or online when you are using products, services, websites and/or applications that are not owned by us. The surveys are not intended to solicit any Sensitive Personal Information and you are prohibited from sharing any Sensitive Personal Information with us through the surveys.

If you choose to share Survey Information with us, you consent to our use of the Survey Information as outlined in this Privacy Policy below. All Survey Information is routed through our affiliate clean room removing all consumer-specific Personally Identifiable Information before we receive it.

You may opt-out of the use of your Survey Information at any time by following the opt-out mechanisms described below.  

How we use Information

We use Information for several important purposes, including:

  • to help us fulfill requests for information or communication;

  • to protect the security of the Products and Sites and individuals who access and use them;

  • to facilitate payment transactions for services;

  • to help prevent fraud;

  • to inform you about new products and services from us, our affiliates, or other companies we work with, as well as promotional offers;

  • to serve personalized advertisements based on your interests, including through retargeting;

  • to better understand your preferences and/or behaviors, including analyzing the Information to predict future preferences and/or behaviors;  

  • to provide you with a website and services of enhanced value to you; and

  • to market and promote our products, services and websites.

We may use Survey Data to analyze such data and share the results of the analyses with our advertiser clients, solely in aggregated and anonymized reports for their internal business purposes (e.g., brand-lift studies, to help them better understand the effectiveness of advertising campaigns, and reach, grow, and/or understand their products and/or services as well as their existing and potential customers and competitors). We consider any such aggregated and anonymized reports to be Non-PII Data.

We use Non-PII Data to improve the Products and the Sites, to gauge the effectiveness of them, and to improve and enhance user experiences with the Products and Sites.

When we Disclose Information  

We only disclose Personally Identifiable Information as described in this Privacy Policy. We may share Information with the following types of parties:

  • Service Providers. We may share your Personally Identifiable Information with our service providers. For example, we may use third party analytics services to collect data about visitors to our Sites and we may use third party match partners to create identity graphs. These service providers are authorized to use your Personally Identifiable Information only as necessary to provide these services on our behalf, and we contractually require our service providers to maintain at least the same level of confidentiality for the Personally Identifiable Information we provide to them as we maintain for such information.

  • Affiliated Businesses. We share Information, including Personally Identifiable Information, with our employees, agents, and affiliates (including Optimum, Suddenlink, ServiceElectric, Altice Mobile, News12 and i24News). We may also share Information, including Personally Identifiable Information, in the event of a merger, acquisition or sale of all, or components of, our business. When we do this, those employees, agents and affiliates will use and protect Information in a manner that is consistent with this Privacy Policy.

  • Lawful Disclosures. You acknowledge and agree that we may disclose your Personally Identifiable Information if we are required to do so by law or if we have a good faith belief that such disclosure is reasonably necessary: 1) to comply with applicable law, a subpoena, court order or other legal process; 2) to investigate violations of this Privacy Policy, any Terms of Use of the Products or other contracts we or our service providers may have with you; 3) to respond to claims that any content violates the rights of third parties; 4) to respond to your requests for customer service; and 5) to protect our rights and property as well as the rights, property, or personal safety of the public, and/or any of our affiliates and/or their respective employees, agents and subscribers. We may also disclose your Personally Identifiable Information to law enforcement agencies in emergency circumstances, where the disclosure of such information is consistent with the types of emergency disclosures permitted or required by law.

 

How Long We Will Keep Information

We retain Information for as long as is reasonable for the purposes for which it was collected unless a longer retention period is required or permitted by law.

 

How We Protect Visitor Information

We follow industry-standard practices to protect Information. All Information is stored in our databases in physically secure facilities. Visitors’ financial and payment card information is transmitted via encrypted technology. If we share Information with our affiliates, the affiliate will follow similar practices to protect Personally Identifiable Information.

Any information transmitted over the Internet may be subject to breaches of security. Although we follow commercially reasonable practices to securely store Information and to work with responsible third parties, we cannot guarantee these practices will prevent every unauthorized attempt to access, use, or disclose such Information.

 

How We Protect Children’s Online Privacy

The Products and the Sites are not intended for, and are not directed to, children under the age of 18. We do not knowingly collect Personally Identifiable Information from children under the age of 18. If you are under 18, do not use or provide any information to us via the Products or the Sites. If we become aware that we have received Personally Identifiable Information of a child under 18 without verification of parental consent, we will delete the information from our records. If you believe we might have information from or about a child under 18, please contact us at privacy@a4media.com or using our postal address set forth below. 

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see the ‘Notice to California Residents: Your California Privacy Rights’ section below for more information. 

Notice to Visitors From Outside the U.S.

The Sites are published in the United States and the Products are intended for use in the United States only. By accessing the Sites, using the Products or providing Personally Identifiable Information to us, our third party data providers, and/or our service providers, you agree that we may collect, use, and disclose your Information, including your Personally Identifiable Information, as described in this Privacy Policy, including by transferring such information from the country where you live to the United States.

 

Notice to California Residents: Your California Privacy Rights

We not sell the Personal Information of California Residents, as both terms are defined under the CCPA. Individuals who reside in California and who have provided their Personally Identifiable Information to us may request information regarding disclosures of this information to third parties for direct marketing purposes. Opt-out Mechanisms: Choice Regarding Communications and Inclusion in Targeted TV + Digital Audiences

  • Offline Data Sources. Opting-out of telemarking and direct mail lists will help prevent your information from being included in lists we license from third parties. You can visit the following site to learn more about those opt outs: https://dmachoice.thedma.org/.

  • Cookie-based advertising. If you would like to opt-out of cookie-based digital advertising generally, the most effective way to do so is via the opt-out mechanisms made available by advertising industry groups, in particular those offered by the Network Advertising Initiative (“NAI“) and the Digital Advertising Alliance (“DAA“). To implement your opt-out choices under the NAI and DAA programs, please visit the NAI Opt-Out Page and the DAA Opt-Out Page.  

  • Authenticated IP Address Audiences. Review your cable/internet service provider’s privacy policies to learn how to opt out of IP address-based targeted advertising.

  • Email. If you wish to opt-out of marketing or promotional email communications from a4, you may opt-out via the unsubscribe link included in such emails.  We will try to comply with your request(s) as soon as reasonably practicable.  Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our services.

  • CTV Audiences. Review the privacy policies of any connected devices you use (e.g., smart TVs, Apple TV, Roku, etc.) to learn how to opt out targeted advertising. 

  • Survey Information. If you wish to revoke your consent for us to use your Survey information, please click Here or send a written request at the address listed below. We will try to comply with your request(s) as soon as reasonably practicable. 

Changes to this Privacy Policy

We may change this Privacy Policy at any time. Your continued use of the Products and/or Sites after any changes go into effect is deemed to be acceptance of those changes, so please periodically review the Privacy Policy to inform yourself of any changes. The revised Privacy Policy will be effective on the date it is posted unless the revised policy states otherwise.
